Terms of Service

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to use the Service. By using the Service you represent that you meet this requirement.

2. Your account

You authenticate via a one-time email link. You are responsible for maintaining the security of your email account and for activity under your PopCastly profile. You may have only one active account.

3. Credits and rewards

The Service uses virtual credits as a scoring mechanic. Credits are awarded on signup and through gameplay events including correct predictions, time-based refills, referrals, and rewarded video ads. Credits:

• have no cash value and are not redeemable;
• cannot be sold, traded, or transferred;
• are licensed to you, not owned by you;
• may be adjusted, suspended, or revoked, with or without notice, including to correct errors or sanction abuse.

4. Markets and resolution

Markets are framed as questions about public events. We resolve markets using the resolution criteria and source published with each market. Resolution decisions are final. We may pause, void, or cancel a market when the source is ambiguous, the event is indeterminate, or operational error has occurred; in those cases we may refund credits at our discretion.

5. Acceptable use

You agree not to:

• operate multiple accounts or impersonate another person;
• use bots, scripts, or automated means to interact with markets or the rewards system;
• attempt to bypass, defraud, or manipulate the rewarded ad system, including by intercepting completion events;
• scrape, copy, or republish substantial portions of the Service;
• upload content that is unlawful, defamatory, or infringes third-party rights;
• interfere with the security or integrity of the Service.

6. Suspension and termination

We may suspend or terminate your access at any time, with or without notice, for breach of these Terms or for the integrity of the Service. You may stop using the Service at any time and request deletion at privacy@popcastly.com.

7. Intellectual property

The Service, including code, design, names, logos, and market copy, is owned by PopCastly or its licensors and is protected by applicable IP laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.

8. Third-party services and ads

The Service may include content from third parties, including advertisements served by Google. Your interactions with third parties are governed by their terms and privacy policies.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, PopCastly will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of credits, profits, data, or goodwill, arising from your use of the Service. Our aggregate liability for any claim relating to the Service will not exceed USD $100.

11. Governing law and disputes

These Terms are governed by the laws of [State / Country to be specified], without regard to conflict-of-laws rules. The courts located in [Venue to be specified] have exclusive jurisdiction over any dispute arising from these Terms, except where prohibited by your local law.
